Article L5124-3 of the French Public Health Code

The opening of a pharmaceutical establishment, whatever its activity, is subject to an authorisation issued by the Agence nationale de sécurité du médicament et des produits de santé. This authorisation may, after formal notice, be suspended or withdrawn in the event of infringement of the provisions of this Book and of Book II of Part IV.

Any substantial modification of the elements of the initial authorisation is subject to prior authorisation. A Conseil d’Etat decree sets out the cases in which the initial authorisation may be substantially modified. Other modifications are subject to a declaration.

L’ouverture d’un établissement pharmaceutique, quelle que soit son activité, est subordonnée à une autorisation délivrée par l’Agence nationale de sécurité du médicament et des produits de santé. Cette autorisation peut, après mise en demeure, être suspendue ou retirée en cas d’infraction aux dispositions du présent livre et du livre II de la partie IV.

Toute modification substantielle des éléments de l’autorisation initiale est subordonnée à une autorisation préalable. Un décret en Conseil d’Etat fixe les cas de modification substantielle de l’autorisation initiale. Les autres modifications font l’objet d’une déclaration.
