Article L5125-23-1 of the French Public Health Code

In the context of chronic treatment, in exceptional circumstances and subject to informing the prescribing doctor, when the period of validity of a renewable prescription has expired and in order to avoid any interruption of treatment detrimental to the patient’s health, the pharmacist may dispense the medicinal products and medical devices necessary for the continuation of treatment, within the limits of the dosage initially laid down, for up to three months, per one-month supply. The prescribing doctor is informed by secure means of communication. The categories of medicinal products and medical devices excluded from the scope of this paragraph are set by an order of the Minister for Health on a proposal from the Agence nationale de sécurité du médicament et des produits de santé (French National Agency for the Safety of Medicines and Health Products).

In the case of oral contraceptives, when the period of validity of a prescription that is less than one year old has expired, the pharmacist may dispense the medicinal products necessary for the continuation of the treatment, unless they are on a list established by an order of the Minister for Health on a proposal from the National Agency for the Safety of Medicines and Health Products, for an additional non-renewable period of six months.

The conditions for application of this article are determined by decree in the Conseil d’Etat.

Dans le cadre d’un traitement chronique, à titre exceptionnel et sous réserve d’informer le médecin prescripteur, lorsque la durée de validité d’une ordonnance renouvelable est expirée et afin d’éviter toute interruption de traitement préjudiciable à la santé du patient, le pharmacien peut dispenser, dans le cadre de la posologie initialement prévue, les médicaments et dispositifs médicaux nécessaires à la poursuite du traitement dans la limite de trois mois, par délivrance d’un mois. Le médecin prescripteur en est informé par des moyens de communication sécurisés. Les catégories de médicaments et de dispositifs médicaux exclues du champ d’application du présent alinéa sont fixées par un arrêté du ministre chargé de la santé sur proposition de l’Agence nationale de sécurité du médicament et des produits de santé.

S’agissant des contraceptifs oraux, lorsque la durée de validité d’une ordonnance datant de moins d’un an est expirée, le pharmacien peut dispenser les médicaments nécessaires à la poursuite du traitement, sauf s’ils figurent sur une liste fixée par un arrêté du ministre chargé de la santé sur proposition de l’Agence nationale de sécurité du médicament et des produits de santé, pour une durée supplémentaire non renouvelable de six mois.

Les conditions d’application du présent article sont déterminées par décret en Conseil d’Etat.
