Article L5125-23-3 of the French Public Health Code

By way of derogation from I of Article L. 5125-23, the pharmacist may dispense a comparable product by way of substitution for the product prescribed if the following conditions are met:

1° This product appears on a list, accompanied, where applicable, by conditions for substitution and information for the prescriber and the patient on the occasion of this substitution, set by a joint order of the ministers responsible for health and social security issued after consulting the Haute Autorité de santé ;

2° Where they exist, the conditions mentioned in 1° of this article may be complied with;

3° The prescriber has not excluded the possibility of this substitution by an express and justified statement on the prescription, taking into account the patient’s medical situation;

4° If the product prescribed appears on the list mentioned in article L. 165-1 of the Social Security Code, this substitution is made under the conditions provided for in article L. 162-16 of the same code.

When the pharmacist dispenses a product by substitution, he/she writes the name of the product he/she has dispensed on the prescription and informs the prescriber and the patient of this substitution.

Article L5125-23-3

Par dérogation au I de l’article L. 5125-23, le pharmacien peut délivrer, par substitution au produit prescrit, un produit comparable lorsque les conditions suivantes sont remplies :

1° Ce produit figure sur une liste, accompagnée, le cas échéant, de conditions de substitution et d’information du prescripteur et du patient à l’occasion de cette substitution, fixée par un arrêté conjoint des ministres chargés de la santé et de la sécurité sociale pris après avis de la Haute Autorité de santé ;

2° Lorsqu’elles existent, les conditions mentionnées au 1° du présent article peuvent être respectées ;

3° Le prescripteur n’a pas exclu la possibilité de cette substitution par une mention expresse et justifiée portée sur l’ordonnance et tenant à la situation médicale du patient ;

4° Si le produit prescrit figure sur la liste mentionnée à l’article L. 165-1 du code de la sécurité sociale, cette substitution s’effectue dans les conditions prévues à l’article L. 162-16 du même code.

Lorsque le pharmacien délivre un produit par substitution, il inscrit le nom du produit qu’il a délivré sur l’ordonnance et informe le prescripteur et le patient de cette substitution.
