I.-The opening by transfer or grouping of a pharmacy in a municipality, or in a new municipality as defined in article L. 2113-1 of the General Local Authorities Code or in the municipalities mentioned in article L. 5125-6-1 of this Code may be authorised when the number of inhabitants counted is at least equal to 2,500.
The opening of an additional dispensary may be authorised by means of a transfer or grouping at the rate of one authorisation per additional whole block of 4,500 inhabitants counted in the municipality, in the new municipality or in the municipalities mentioned in article L. 5125-6-1.
If the last pharmacy in a municipality with a population of less than 2,500 has ceased trading for good, and if it previously served a population of at least 2,500, a new authorisation may be issued to set up a pharmacy by transfer or grouping together in this municipality.
II – By way of derogation from the provisions of the first paragraph, the quota of 2,500 inhabitants is set at 3,500 inhabitants for the department of Guyana and the departments of Moselle, Bas-Rhin and Haut-Rhin.
III – The number of inhabitants taken into account for the application of this article is the municipal population as it results from the last population census published in the Journal officiel de la République française.
