Article L5125-6-2 of the French Public Health Code

By way of derogation from the provisions of Article L. 5125-3-2, within the territories referred to in Article L. 5125-6, the optimum response to the population’s need for medicinal products is assessed solely with regard to the conditions set out in 1° and 2° of Article L. 5125-3-2. The Director General of the Regional Health Agency may, within these territories, authorise the opening of a pharmacy by means of transfer or grouping, in particular within a shopping centre, a nursing home or a health centre.

Article L5125-6-2

Par dérogation aux dispositions de l’article L. 5125-3-2, au sein des territoires mentionnés à l’article L. 5125-6, la réponse optimale aux besoins en médicaments de la population est appréciée au regard des seules conditions prévues aux 1° et 2° de l’article L. 5125-3-2. Le directeur général de l’agence régionale de santé peut, au sein de ces territoires, autoriser l’ouverture d’une officine par voie de transfert ou de regroupement, notamment auprès d’un centre commercial, d’une maison de santé ou d’un centre de santé.
