Article L5145-8 of the French Public Health Code

Where a failure to comply with the rules governing the holding, prescription, supply or use of veterinary medicinal products provided for in this chapter is observed, and except in an emergency, the administrative authority shall give formal notice to the party concerned to comply with these obligations within a period which it shall determine. It shall invite the person concerned to submit written or oral observations within the same time limit, assisted, where appropriate, by a counsel of his choice or by being represented. If, on expiry of this period, the interested party has not complied with the injunction, or without delay in an emergency, the administrative authority may order the suspension of the activity in question until the operator has complied with the injunction.

The administrative authority may also, under the same conditions, order the temporary administrative closure of the establishment.

A decree in the Conseil d’Etat shall specify the procedures for application of this article.

Lorsqu’un manquement aux règles de détention, de prescription, de délivrance ou d’utilisation des médicaments vétérinaires prévues au présent chapitre est constaté, et sauf urgence, l’autorité administrative met en demeure l’intéressé de satisfaire à ces obligations dans un délai qu’elle détermine. Elle l’invite à présenter ses observations écrites ou orales dans le même délai en se faisant assister, le cas échéant, par un conseil de son choix ou en se faisant représenter. Si, à l’expiration de ce délai, l’intéressé n’a pas obtempéré à cette injonction, ou sans délai en cas d’urgence, l’autorité administrative peut ordonner la suspension de l’activité en cause jusqu’à ce que l’exploitant se soit conformé à son injonction.

L’autorité administrative peut également, dans les mêmes conditions, prononcer la fermeture administrative provisoire de l’établissement.

Un décret en Conseil d’Etat précise les modalités d’application du présent article.
