Article L5146-4-1 of the French Public Health Code

The agents mentioned in 2°, 3° and 4° of the I of article L. 5146-1 may order the immediate denaturing or destruction, by any approved disposal channel, of the following products:

1° Veterinary medicinal products that have expired or do not have an expiry date placed in usable stock;

2° Veterinary medicinal products recognised as unfit for use or likely to present a danger to public health;

3° Veterinary medicinal products that are not authorised or do not comply with the regulations in force.

These operations are at the expense of and carried out under the responsibility of the holder of the products. They are described and justified in an inspection report which includes any observations made by the product holder.

A copy of the inspection report is given to the product holder.

Article L5146-4-1

Les agents mentionnés aux 2°, 3° et au 4° du I de l’article L. 5146-1 peuvent ordonner la dénaturation immédiate ou la destruction, par toute filière agréée d’élimination, des produits suivants :

1° Les médicaments vétérinaires périmés ou dépourvus de date de péremption placés dans le stock utilisable ;

2° Les médicaments vétérinaires reconnus impropres à leur utilisation ou susceptibles de présenter un danger pour la santé publique ;

3° Les médicaments vétérinaires non-autorisés ou non conformes à la réglementation en vigueur.

Ces opérations sont à la charge et effectuées sous la responsabilité du détenteur des produits. Elles sont relatées et justifiées dans un rapport d’inspection qui mentionne les observations éventuelles du détenteur des produits.

Une copie du rapport d’inspection est remise au détenteur des produits.
