Article L5212-15 of the French General Code of Local Authorities

The administration of establishments which are the subject of syndicates is subject to the rules of ordinary law.

In particular, the laws which lay down, for similar establishments, the constitution of advisory or supervisory committees, the composition or appointment of staff, the formation and approval of budgets, the approval of accounts, the rules of internal administration and accounting are applicable to them.

With regard to these establishments, the syndicate committee exercises the rights that belong to municipal councils with regard to communal establishments of the same nature.

However, if the syndicate’s purpose is to provide relief for the sick, the elderly, children or incurable persons, the committee may decide that a commission will administer the relief, on the one hand, at home and, on the other hand, at the hospital or hospice.

L’administration des établissements faisant l’objet des syndicats est soumise aux règles du droit commun.

Leur sont notamment applicables les lois qui fixent, pour les établissements analogues, la constitution des commissions consultatives ou de surveillance, la composition ou la nomination du personnel, la formation et l’approbation des budgets, l’approbation des comptes, les règles d’administration intérieure et de comptabilité.

Le comité du syndicat exerce à l’égard de ces établissements les droits qui appartiennent aux conseils municipaux à l’égard des établissements communaux de même nature.

Toutefois, si le syndicat a pour objet de secourir des malades, des vieillards, des enfants ou des incurables, le comité peut décider qu’une commission administrera les secours, d’une part, à domicile et, d’autre part, à l’hôpital ou à l’hospice.
