Article L5212-17 of the French General Code of Local Authorities

The provisions of article L. 5212-16 to unions existing on 6 January 1988, the date of publication of the loi n° 88-13 du 5 janvier 1988 d’amélioration de la décentralisation, if the municipal councils of the member municipalities of these unions have made known, under the majority conditions provided for in II of article L. 5211-5, their willingness to amend the decision to set up the syndicat accordingly.

The modification decision is taken by the representative of the State in the department.

Article L5212-17

Il peut être fait application des dispositions de l’article L. 5212-16 aux syndicats existant à la date du 6 janvier 1988, date de publication de la loi n° 88-13 du 5 janvier 1988 d’amélioration de la décentralisation, si les conseils municipaux des communes membres de ces syndicats ont fait connaître, dans les conditions de majorité prévues au II de l’article L. 5211-5, leur volonté de modifier en conséquence la décision d’institution du syndicat.

La décision de modification est prise par le représentant de l’Etat dans le département.
