Article L5212-2 of the French General Code of Local Authorities

Unless it is the result of concordant deliberations by all the municipal councils, the creation of a syndicate of municipalities gives rise to the drawing up of a list of the municipalities concerned. This list is drawn up by the representative(s) of the State in the department(s) concerned, on the initiative of one or more municipal councils. It is sent to the departmental council for information.

Sauf lorsqu’elle résulte des délibérations concordantes de l’ensemble des conseils municipaux, la création d’un syndicat de communes donne lieu à l’établissement d’une liste des communes intéressées. Cette liste est fixée par le ou les représentants de l’Etat dans le ou les départements concernés, sur l’initiative d’un ou plusieurs conseils municipaux. Elle est communiquée pour information au conseil départemental .
