Article L5212-5 of the French Labour Code

The employer shall declare its situation with regard to the employment obligation to which it is subject pursuant to article L. 5212-2 of this Code by means of the declaration provided for in article L. 133-5-3 of the Social Security Code.

If no declaration is made, the employer is deemed not to have fulfilled the employment obligation.

The information contained in this declaration is confidential. It may not be communicated to another employer from whom a beneficiary of the employment obligation whom the declaration concerns applies for a job.

L’employeur déclare sa situation au regard de l’obligation d’emploi à laquelle il est soumis en application de l’article L. 5212-2 du présent code au moyen de la déclaration prévue à l’article L. 133-5-3 du code de la sécurité sociale.

A défaut de toute déclaration, l’employeur est considéré comme ne satisfaisant pas à l’obligation d’emploi.

Les informations contenues dans cette déclaration sont confidentielles. Elles ne peuvent être communiquées à un autre employeur auprès duquel un bénéficiaire de l’obligation d’emploi que la déclaration concerne sollicite un emploi.
