Disabled worker status is recognised by the Commission des droits et de l’autonomie des personnes handicapées (Commission on the Rights and Independence of Disabled People) referred to in article L. 241-5 du code de l’action sociale et des familles. This recognition is accompanied by referral to an establishment or service providing assistance through work, to the labour market or to a vocational rehabilitation centre. Discharge from a work-support establishment or service to the mainstream labour market takes place as part of a reinforced employment programme, the terms and conditions of which are set by decree. Referral to a work-support establishment or service, to the labour market or to a vocational re-education centre constitutes recognition of the status of disabled worker. For minors aged sixteen or over, the allocation of the allowance mentioned inarticle L. 541-1 of the Social Security Code or the benefit mentioned in article L. 245-1 du code de l’action sociale et des familles as well as the benefit of a personalised schooling project constitute recognition of the status of disabled worker. Where the disability is irreversible, disabled worker status is granted on a permanent basis.
