Article L5215-40 of the French General Code of Local Authorities

The perimeter of the conurbation in which the urban community exercises its powers may subsequently be extended, by order of the State representative in the département, by the addition of new communes, either at the request of their municipal councils or on the initiative of the community council.

The modification is subject in the first case to the agreement of the community council and in the second case to that of the municipal council or councils concerned.

Le périmètre de l’agglomération dans laquelle la communauté urbaine exerce ses compétences peut être ultérieurement étendu, par arrêté du représentant de l’Etat dans le département, par adjonction de communes nouvelles, soit à la demande de leurs conseils municipaux, soit sur l’initiative du conseil de communauté.

La modification est subordonnée dans le premier cas à l’accord du conseil de communauté et dans le second cas à celui du ou des conseils municipaux intéressés.
