The syndicate committee and the syndic ensure the administration and development of undivided property and rights. Their powers are the same as those of town councils and mayors in similar matters.
However, sales, exchanges, divisions, acquisitions of real estate and related transactions remain reserved for town councils, which may authorise the president of the commission to pass the related deeds. Decisions concerning the acquisition of real estate and related transactions, as well as the conclusion of leases exceeding eighteen years, are taken by a majority of at least two-thirds of the municipal councils of the municipalities concerned.
At the proposal of the syndicate commission, the distribution of all or part of the surplus of income or expenditure voted by it is made between the municipalities by deliberation of the municipal councils. This decision must be taken within three months of the communication of the distribution proposals drawn up by the syndicate commission.
In the event of disagreement between the municipal councils on this distribution or if all the municipal councils have not voted within the time limit set in the previous paragraph, the distribution of the surplus revenue or expenditure is decided by the representative of the State in the department. If the municipal councils belong to different départements, the decision is taken by joint order of the representatives of the State in the départements concerned.
The share of the expenditure definitively assigned to each commune constitutes compulsory expenditure.
The provisions of Title I and Title IV of Book III of Part Two are applicable to joint ownership between communes.
