When a commune requests that the undivided ownership in respect of it be terminated, the syndicate commission to which the request is referred notifies that commune, within a period of six months, of a draft definition of the lot or compensation to be allocated to it. The costs of the expert appraisal are borne by the commune.
The commune leaving the undivided ownership arrangement receives, as a priority, a lot located on its territory. It may claim, in return for compensation in money or in kind, the allocation of properties whose value exceeds the share to which it is entitled when, for their proper management, these properties must not be subdivided or when they are necessary for the development of the commune’s facilities or urbanisation policy.
However, where the allocation in kind cannot be made without seriously compromising the operation or financial equilibrium of the undivided interest, the commune that requested its withdrawal receives the value of its share and the property remains in the undivided interest.
If a commune decides to withdraw from the indivision, no act modifying the value of the properties and what is attached to them may take place during the time that elapses between the requests for withdrawal from the indivision and the allocation of the lots constituted.
In the absence of notification within the period of six months referred to in the first paragraph or in the event of persistent disagreement after the expiry of a period of six months from the date on which the commune was informed of the draft drawn up by the syndicate commission, the expropriation judge, seized either by one of the interested communes or by the syndicate commission, will rule on the allocation of the lot or on the value of the compensation.
