Failure to comply with the provisions of article L. 5222-1 is punishable by three years’ imprisonment and a fine of 45,000 euros.
The court may also impose the following additional penalties:
1° A ban, for a period of up to five years, on carrying out directly or through an intermediary the professional activity in the exercise or on the occasion of the exercise of which the offence was committed, in accordance with the provisions ofarticle 131-27 of the Criminal Code ;
2° Exclusion from public contracts for a maximum of five years;
3° Confiscation of objects that were used, directly or indirectly, to commit the offence or that were used in connection with the offence, regardless of who they belong to, provided that their owner could not have been unaware of their fraudulent use, as well as objects that are the proceeds of the offence and that belong to the convicted person;
4° Posting the judgment at the expense of the convicted person in accordance with the conditions set out inarticle 131-35 of the Criminal Code and publishing it, in full or in excerpts, in the newspapers designated by the convicted person. These costs may not exceed the maximum fine incurred;
5° A ban on civic, civil and family rights, in accordance with the provisions ofarticle 131-26 of the Criminal Code;
6° A ban on residence for a maximum of five years.
