Article L531-32 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The French Office for the Protection of Refugees and Stateless Persons may take a written, reasoned decision of inadmissibility, without checking whether the conditions for granting asylum have been met, in the following cases:
1° Where the applicant enjoys effective protection as an asylum seeker in a Member State of the European Union;
2° Where the applicant enjoys refugee status and effective protection in a third country and is effectively readmissible there;
3° In the event of an application for re-examination where, following a preliminary examination carried out in accordance with the procedure defined in article L. 531-42, it appears that this application does not meet the conditions laid down in the same article.

L’Office français de protection des réfugiés et apatrides peut prendre une décision d’irrecevabilité écrite et motivée, sans vérifier si les conditions d’octroi de l’asile sont réunies, dans les cas suivants :
1° Lorsque le demandeur bénéficie d’une protection effective au titre de l’asile dans un Etat membre de l’Union européenne ;
2° Lorsque le demandeur bénéficie du statut de réfugié et d’une protection effective dans un Etat tiers et y est effectivement réadmissible ;
3° En cas de demande de réexamen lorsque, à l’issue d’un examen préliminaire effectué selon la procédure définie à l’article L. 531-42, il apparaît que cette demande ne répond pas aux conditions prévues au même article.
