Article L5311-3-1 of the French Labour Code

The State may delegate to the region, under the conditions set out inarticle L. 1111-8-1 of the General Local Authorities Code and after consulting the Regional Employment, Training and Vocational Guidance Committee, the task of ensuring the complementarity and coordinating the action of the various players, in particular the local missions, the local multi-year plans for integration and employment, Cap Emploi and the employment centres, as well as implementing the territorial forward planning of jobs and skills, without prejudice to the prerogatives of the institution mentioned in Article L. 5312-1 of this Code. The region assesses the rate of integration into employment.

The delegation agreement signed between the presidents of the delegating regions and the representative of the State specifies the objectives and the conditions for exercising and monitoring the delegation, in particular the conditions for the transfer by the State to the delegating regions of credits allocated outside national employment policy schemes.

Article L5311-3-1

L’Etat peut déléguer à la région, dans les conditions prévues à l’article L. 1111-8-1 du code général des collectivités territoriales et après avis du comité régional de l’emploi, de la formation et de l’orientation professionnelles, la mission de veiller à la complémentarité et de coordonner l’action des différents intervenants, notamment les missions locales, les plans locaux pluriannuels pour l’insertion et l’emploi, Cap emploi et les maisons de l’emploi, ainsi que de mettre en œuvre la gestion prévisionnelle territoriale des emplois et des compétences, sans préjudice des prérogatives de l’institution mentionnée à l’article L. 5312-1 du présent code. La région évalue le taux d’insertion dans l’emploi.

La convention de délégation signée entre les présidents des régions délégataires et le représentant de l’Etat précise les objectifs et les conditions d’exercice et de suivi de la délégation, notamment les conditions de transfert par l’Etat aux régions délégataires des crédits affectés hors dispositifs nationaux des politiques de l’emploi.
