Article L5312-2 of the French Public Health Code

Without prejudice to any criminal proceedings that may be brought, where a product or group of products referred to in Article L. 5311-1 is placed on the market, put into service or used without having obtained the prior authorisation, registration or certification required by the legislative or regulatory provisions applicable to this product or group of products, the Agency may suspend, until the product or group of products has been brought into compliance with the laws and regulations in force, the testing, manufacture, preparation, import, use, export, wholesale distribution, packaging, storage, placing on the market free of charge or against payment, holding with a view to sale or free distribution, advertising, putting into service, use, prescription, dispensing or administration of this product or group of products.

Except in emergencies, the natural or legal person concerned must be given the opportunity to present its observations before the suspension measures are taken.

Article L5312-2

Sans préjudice des poursuites pénales qui peuvent être exercées, lorsqu’un produit ou groupe de produits mentionné à l’article L. 5311-1 est mis sur le marché, mis en service ou utilisé sans avoir obtenu l’autorisation, l’enregistrement ou la certification préalable exigé par les dispositions législatives ou réglementaires applicables à ce produit ou groupe de produits, l’agence peut suspendre, jusqu’à la mise en conformité du produit ou groupe de produits au regard de la législation et de la réglementation en vigueur, les essais, la fabrication, la préparation, l’importation, l’exploitation, l’exportation, la distribution en gros, le conditionnement, la conservation, la mise sur le marché à titre gratuit ou onéreux, la détention en vue de la vente ou de la distribution à titre gratuit, la publicité, la mise en service, l’utilisation, la prescription, la délivrance ou l’administration de ce produit ou groupe de produits.

Sauf en cas d’urgence, la personne physique ou morale concernée doit être mise à même de présenter ses observations avant l’intervention de ces mesures de suspension.
