Article L5413-1 of the French Public Health Code

In the premises, places, installations and vehicles to which they have access pursuant to article L. 1421-2, as well as in public places, the medical inspectors of public health and the inspectors of the regional health agencies with the status of medical doctor, authorised and sworn in under the conditions laid down by decree in the Conseil d’Etat, are authorised to investigate and record breaches of the laws and regulations relating to the activities and products mentioned in article L. 5311-1 as well as to the provisions of Title II of Book I of the Consumer Code when the infringement concerns one of these products, to article L. 1151-1 as well as to the regulatory measures taken for its application.

The provisions of articles L. 1421-3, L. 5411-2, L. 5411-3 and L. 5411-4 are applicable to the exercise of this mission.

Article L5413-1

Dans les locaux, lieux, installations et véhicules auxquels ils ont accès en application de l’article L. 1421-2, ainsi que dans les lieux publics, les médecins inspecteurs de santé publique et les inspecteurs des agences régionales de santé ayant la qualité de médecin habilités et assermentés dans des conditions fixées par décret en Conseil d’Etat ont qualité pour rechercher et constater les infractions aux lois et règlements relatifs aux activités et aux produits mentionnés à l’article L. 5311-1 ainsi qu’aux dispositions du titre II du livre Ier du code de la consommation lorsque l’infraction porte sur un de ces produits, à l’article L. 1151-1 ainsi qu’aux mesures réglementaires prises pour son application.

Les dispositions des articles L. 1421-3, L. 5411-2, L. 5411-3 et L. 5411-4 sont applicables à l’exercice de cette mission.
