Article L5422-1-1 of the French Labour Code

In order to benefit from the insurance allowance under II of article L. 5422-1, prior to resigning, the employee requests professional development advice from the institutions, bodies or operators mentioned in article L. 6111-6, with the exception of Pôle emploi and the bodies mentioned in article L. 5314-1, under the conditions set out in article L. 6111-6. Where applicable, the institution, body or operator in charge of career development advice informs the employee of the rights that he/she may claim in order to implement his/her project within the framework of his/her employment contract.

With the assistance of the institution, body or operator, the employee draws up the professional retraining project referred to in 2° of II of article L. 5422-1.

Article L5422-1-1

Pour bénéficier de l’allocation d’assurance au titre du II de l’article L. 5422-1, le travailleur salarié demande, préalablement à sa démission, un conseil en évolution professionnelle auprès des institutions, organismes ou opérateurs mentionnés à l’article L. 6111-6, à l’exception de Pôle emploi et des organismes mentionnés à l’article L. 5314-1, dans les conditions prévues à l’article L. 6111-6. Le cas échéant, l’institution, l’organisme ou l’opérateur en charge du conseil en évolution professionnelle informe le travailleur salarié des droits qu’il pourrait faire valoir pour mettre en œuvre son projet dans le cadre de son contrat de travail.

Le travailleur salarié établit avec le concours de l’institution, de l’organisme ou de l’opérateur le projet de reconversion professionnelle mentionné au 2° du II de l’article L. 5422-1.
