Participatory finance intermediation consists of bringing together, by means of a website, the promoters of a given project and the persons financing that project under the following conditions:
1° Legal entities and, when acting for professional purposes, natural persons seeking financing for activities other than those governed by Regulation (EU) 2020/1503 of 7 October 2020 may obtain the loans mentioned in Article L. 511-6(7), free loans and donations ;
2° Natural persons wishing to finance initial or continuing training may obtain the loans mentioned in Article L. 511-6(7), free loans provided that the lenders are not acting in a professional or commercial capacity, and donations;
3° Natural persons not acting for professional purposes may obtain loans free of charge, provided that the lenders are not acting in a professional or commercial capacity, and donations.
For the purposes of this chapter, a project consists of a predefined operation or set of predefined operations, an event or the support of a cause for which a project owner is seeking total or partial financing. Where applicable, the project sponsor may rely on the compliance of this operation or set of operations with the purpose declared by the company within the meaning of article 1835 of the French Civil Code.
The organisations mentioned in article L. 511-6(5) may only receive loans free of charge under the conditions set out in the same article, and donations.
A decree sets the respective ceilings for loans against payment and free loans, granted per lender, as well as the total amount and maximum term of the loan that may be taken out by each project promoter.
The total amount of outstanding loans taken out in the form of equity financing within the meaning of this chapter may not exceed the ceiling for the total amount of the loan granted mentioned in the previous paragraph for any one project.
The intermediary in the form of equity financing shall obtain from the project holder all information necessary to ensure that the project holder fulfils this condition. Any information provided by the project owner that is incorrect or likely to mislead the equity intermediary is the responsibility of the project owner.
