For its application in Mayotte, article L. 5125-18 reads as follows:
“Art. L. 5125-18.-I.-Any creation of a new pharmacy, any transfer of a pharmacy from one location to another and any grouping of pharmacies are subject to the granting of a licence issued by the Director General of the Mayotte Regional Health Agency in accordance with the conditions set out in articles L. 5125-3 to L. 5125-5. The licence specifies the location where the pharmacy will be operated.
“II – When a request for the creation, transfer or consolidation of a pharmacy is submitted to the Director General of the Mayotte Regional Health Agency, he/she will consult the local representative appointed by each trade union representing the profession within the meaning of article L. 162-33 of the Social Security Code and the Central Council of Section E of the Ordre National des Pharmaciens.
“It may determine the sector or sectors of the municipality in which the pharmacy is to be located. The decision to authorise or refuse the application is taken by order of the Director General of the Mayotte Regional Health Agency.
