Article L5541-2 of the French Public Health Code

The provisions of Title I of Book III of this Part relating to the National Agency for the Safety of Medicines and Health Products established in Title II of Book III of the same Part shall apply within the limits of the provisions extended to New Caledonia and French Polynesia and subject to the adaptations provided for in this Chapter.

In other cases, the Agency may enter into agreements with the authorities of New Caledonia and French Polynesia.

Article L. 5311-1 is applicable in New Caledonia and French Polynesia in the version resulting from Order no. 2022-1086 of 29 July 2022.

Article L. 5312-3 is applicable there in the version resulting fromOrder no. 2022-1086 of 29 July 2022.

Article L. 5313-1 shall apply in its wording resulting fromOrder no. 2022-582 of 20 April 2022, subject to replacing the reference to Regulation (EU) 2017/745 with the reference to the rules applicable in mainland France pursuant to Regulation (EU) 2017/745 of the European Parliament and of the Council of 5 April 2017.

Article L5541-2

Les dispositions du titre Ier du livre III de la présente partie relatives à l’Agence nationale de sécurité du médicament et des produits de santé instituée au titre II du livre III de la même partie sont applicables dans la limite des dispositions étendues en Nouvelle-Calédonie et en Polynésie française et sous réserve des adaptations prévues au présent chapitre.

Dans les autres cas, l’Agence peut passer des conventions avec les autorités de la Nouvelle-Calédonie et de la Polynésie française.

L’article L. 5311-1 est applicable en Nouvelle-Calédonie et en Polynésie française dans sa rédaction résultant de l’ordonnance n° 2022-1086 du 29 juillet 2022.

L’article L. 5312-3 y est applicable dans sa rédaction résultant de l’ordonnance n° 2022-1086 du 29 juillet 2022.

L’article L. 5313-1 y est applicable dans sa rédaction résultant de l’ordonnance n° 2022-582 du 20 avril 2022, sous réserve de remplacer la référence au règlement (UE) 2017/745 par la référence aux règles applicables en métropole en vertu du règlement (UE) 2017/745 du Parlement européen et du Conseil du 5 avril 2017.
