Article L5842-11 of the French General Code of Local Authorities

I. – The articles L. 5211-42 to L. 5211-45 are applicable in French Polynesia subject to the adaptations provided for in II to IV.

II. – For the application of Article L. 5211-42, the words “in each department” and the word “departmental” are deleted.

III. – For the application of Article L. 5211-43 :

1° In 1° of I, the percentage: “40%” is replaced by the percentage: “60%”;

2° In 2° of the same I, the percentage: “40%” is replaced by the percentage: “20%” and the words: “having their registered office in the department,” as well as the words: “with the exception of syndicates of communes” are deleted;

3° 3° and 4° of the said I are worded as follows:

“3° 15% by representatives of the Assembly of French Polynesia, elected by the latter by proportional representation using the highest average;

“4° 5% by members of the Government of French Polynesia appointed by the President of the Government. ;

4° 5° of the same I is repealed and the penultimate paragraph of the same I is deleted;

5° II is worded as follows:

“II. – As long as they are not members of the French Polynesia inter-municipal cooperation commission by virtue of a local mandate, the deputies and senators elected in French Polynesia are associated with the work of the commission, without the right to vote. “

IV. – For the application of Article L. 5211-45:

1° The penultimate sentence of the first paragraph is deleted;

2° In the second paragraph, the words: “and half of the college referred to in 3° of the same Article L. 5211-43” are deleted.

Article L5842-11

I. – Les articles L. 5211-42 à L. 5211-45 sont applicables en Polynésie française sous réserve des adaptations prévues aux II à IV.

II. – Pour l’application de l’article L. 5211-42, les mots : ” dans chaque département ” et le mot : ” départementale ” sont supprimés.

III. – Pour l’application de l’article L. 5211-43 :

1° Au 1°du I, le pourcentage : ” 40 % ” est remplacé par le pourcentage : ” 60 % ” ;

2° Au 2° du même I, le pourcentage : ” 40 % ” est remplacé par le pourcentage : ” 20 % ” et les mots : ” ayant leur siège dans le département, ” ainsi que les mots : ” à l’exception des syndicats de communes ” sont supprimés ;

3° Les 3° et 4° dudit I sont ainsi rédigés :

” 3° 15 % par des représentants de l’assemblée de la Polynésie française, élus par celle-ci à la représentation proportionnelle à la plus forte moyenne ;

” 4° 5 % par des membres du gouvernement de la Polynésie française désignés par le président du gouvernement. ;

4° Le 5° du même I est abrogé et l’avant-dernier alinéa du même I est supprimé ;

5° Le II est ainsi rédigé :

“ II. – Dès lors qu’ils ne sont pas membres de la commission de la coopération intercommunale de la Polynésie française au titre d’un mandat local, les députés et les sénateurs élus en Polynésie française sont associés aux travaux de la commission, sans voix délibérative. ”

IV. – Pour l’application de l’article L. 5211-45 :

1° L’avant-dernière phrase du premier alinéa est supprimée ;

2° Au second alinéa, les mots : ” et de la moitié du collège visé au 3° du même article L. 5211-43 ” sont supprimés.
