Article L612-3 of the French Intellectual Property Code

Where two patent applications are filed successively by the same inventor or his successor in title within a period of not more than twelve months, the applicant may request that the second application benefit from the filing date of the first for the elements common to both applications.

The request shall not be admissible where the benefit of the right of priority attached to a previous foreign filing has already been requested for either of the two applications. Nor shall it be admissible where the first application already benefits, by application of the provisions of the first paragraph, from several filing dates, one of which is more than twelve months earlier.

The grant of the patent benefiting from an earlier filing date pursuant to this Article shall terminate the effects attached to the first filing in respect of those same elements.

Article L612-3

Lorsque deux demandes de brevet sont successivement déposées par le même inventeur ou son ayant cause dans un délai de douze mois au plus, le demandeur peut requérir que la seconde demande bénéficie de la date de dépôt de la première pour les éléments communs aux deux demandes.

La requête n’est pas recevable lorsque le bénéfice du droit de priorité attaché à un précédent dépôt étranger a déjà été requis pour l’une ou l’autre des deux demandes. Elle n’est pas non plus recevable lorsque la première demande bénéficie déjà, par application des dispositions du premier alinéa, de plusieurs dates de dépôt dont l’une antérieure de plus de douze mois.

La délivrance du brevet bénéficiant d’une date de dépôt antérieure en application du présent article emporte cessation des effets attachés au premier dépôt pour ces mêmes éléments.
