Article L612-3 of the French Monetary and Financial Code

The following are not subject to AMF supervision

1° The management of a statutory sickness and maternity insurance scheme and insurance against accidents at work and occupational diseases, as referred to in Title IV of Book IV of the Insurance Code;

2° Supplementary pension operations carried out by institutions governed by Book IX of the Social Security Code which are subject to inter-professional and general compensation;

3° Management of a statutory sickness and maternity insurance scheme and management of activities and benefits on behalf of the State or other public bodies referred to in 4° of I of article L. 111-1 of the Mutual Code;

4° Operations carried out on behalf of the State by the body mentioned in the first paragraph of article L. 432-2 of the Insurance Code.

Article L612-3

Ne sont pas soumises au contrôle de l’Autorité :

1° Les opérations de gestion d’un régime légal d’assurance maladie et maternité et d’assurance contre les accidents du travail et les maladies professionnelles, mentionnées au titre IV du livre IV du code des assurances ;

2° Les opérations de retraite complémentaire réalisées par les institutions régies par le livre IX du code de la sécurité sociale faisant l’objet d’une compensation interprofessionnelle et générale ;

3° Les opérations de gestion d’un régime légal d’assurance maladie et maternité et de gestion d’activités et de prestations pour le compte de l’Etat ou d’autres collectivités publiques mentionnées au 4° du I de l’article L. 111-1 du code de la mutualité ;

4° Les opérations réalisées pour le compte de l’Etat par l’organisme mentionné au premier alinéa de l’article L. 432-2 du code des assurances.
