Article L612-30 of the French Monetary and Financial Code

Where the Autorité de contrôle prudentiel et de résolution finds that a person subject to its supervision is engaging in practices that are likely to jeopardise the interests of its customers, policyholders, members or beneficiaries, it may, after giving its managers the opportunity to present their explanations, warn the person against continuing such practices insofar as they infringe the rules of good practice of the profession concerned.

Lorsqu’elle constate qu’une personne soumise à son contrôle a des pratiques susceptibles de mettre en danger les intérêts de ses clients, assurés, adhérents ou bénéficiaires, l’Autorité de contrôle prudentiel et de résolution peut, après avoir mis ses dirigeants en mesure de présenter leurs explications, la mettre en garde à l’encontre de la poursuite de ces pratiques en tant qu’elles portent atteinte aux règles de bonne pratique de la profession concernée.
