Article L612-9 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Unless they have not complied with a previous decision requiring them to leave French territory or if their behaviour constitutes a threat to public order, articles L. 612-6, L. 612-7 and L. 612-8 do not apply to foreign nationals required to leave French territory on the grounds that the residence permit issued to them under articles L. 425-1 or L. 425-3 has not been renewed or has been withdrawn or that, as the holder of a residence permit issued on the same basis in another Member State of the European Union, he or she has not returned to the territory of that State on expiry of his or her right of movement on French territory within the time limit, if any, set for him or her.

Sauf s’il n’a pas satisfait à une précédente décision portant obligation de quitter le territoire français ou si son comportement constitue une menace pour l’ordre public, les articles L. 612-6, L. 612-7 et L. 612-8 ne sont pas applicables à l’étranger obligé de quitter le territoire français au motif que le titre de séjour qui lui avait été délivré en application des articles L. 425-1 ou L. 425-3 n’a pas été renouvelé ou a été retiré ou que, titulaire d’un titre de séjour délivré sur le même fondement dans un autre Etat membre de l’Union européenne, il n’a pas rejoint le territoire de cet État à l’expiration de son droit de circulation sur le territoire français dans le délai qui lui a, le cas échéant, été imparti.
