When a credit institution, finance company, electronic money institution, payment institution or one of the persons mentioned in 2° of A of I of Article L. 612-2 has been struck off or banned from activity, as appropriate, or when a company is unlawfully carrying out the activity defined in Article L. 311-1, II of Article L. 314-1 and Article L. 511-1 or breaches one of the prohibitions defined in Article L. 511-5, Article L. 521-2 or Article L. 525-3, the Autorité de contrôle prudentiel et de résolution may, under the conditions set out in Article L. 612-35, appoint a liquidator to whom all powers of administration, management and representation of the legal entity are transferred.
Where the situation gives reason to fear that the credit institution or one of the persons subject to the supervision of the Autorité de contrôle prudentiel et de résolution will eventually be unable to pay the liquidator’s remuneration and expenses, the Fonds de garantie des dépôts et de résolution or the French Treasury may, in accordance with the terms and conditions set out in Article L. 612-34, decide to guarantee payment.
