Article L6146-1-1 of the French Public Health Code

The departments referred to in Article L. 6146-1 are the benchmark for the organisation, relevance, quality and safety of care, local supervision of medical and paramedical teams, supervision of interns and health students and quality of life at work.

They are managed by a department head, who is responsible for the internal structure, in close collaboration with the health executive.

In hospitals and university hospital centres, the head of department is appointed by joint decision of the director of the establishment and the chairman of the establishment’s medical commission, after consulting the head of the department.

When the head of department is an army practitioner, the appointment decision is taken jointly by the director of the establishment, the chairman of the establishment’s medical commission and the Minister of Defence.

The term of office of heads of department is set by decree. Their term of office may be renewed under the same conditions.

The head of department and the health executive are involved in the establishment’s project, the participative governance and management project and projects to develop the establishment’s internal organisation. For the application of article L. 6146-1, the head of department is in particular involved in the implementation of the institution’s policy by the head of the department, in order to achieve the objectives set for the department. The head of the department may delegate his or her signature to the head of the department for the implementation of the department contract provided for in the same article L. 6146-1.

The head of the department and the health executive shall organise internal consultation and promote dialogue with the department’s management and medical and paramedical staff.

The procedures for the application of this article shall be defined by decree.

Article L6146-1-1

Les services mentionnés à l’article L. 6146-1 constituent l’échelon de référence en matière d’organisation, de pertinence, de qualité et de sécurité des soins, d’encadrement de proximité des équipes médicales et paramédicales, d’encadrement des internes et des étudiants en santé ainsi qu’en matière de qualité de vie au travail.

Ils sont dirigés par un chef de service, responsable de structure interne, en étroite collaboration avec le cadre de santé.

Dans les centres hospitaliers et les centres hospitaliers universitaires, le chef de service est nommé par décision conjointe du directeur d’établissement et du président de la commission médicale d’établissement, après avis du chef de pôle.

Lorsque le chef de service est un praticien des armées, la décision de nomination est prise conjointement par le directeur d’établissement, le président de la commission médicale d’établissement et le ministre de la défense.

La durée du mandat des chefs de service est fixée par décret. Leur mandat peut être renouvelé dans les mêmes conditions.

Le chef de service et le cadre de santé sont associés au projet d’établissement, au projet de gouvernance et de management participatif et aux projets d’évolution de l’organisation interne de l’établissement. Pour l’application de l’article L. 6146-1, le chef de service est notamment associé par le chef de pôle à la mise en œuvre de la politique de l’établissement afin d’atteindre les objectifs fixés au pôle. Le chef de pôle peut déléguer sa signature au chef de service pour la mise en œuvre du contrat de pôle prévu au même article L. 6146-1.

Le chef de service et le cadre de santé organisent la concertation interne et favorisent le dialogue avec l’encadrement et les personnels médicaux et paramédicaux du service.

Les modalités d’application du présent article sont définies par décret.
