Article L621-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

As an exception to the refusal of entry at the border provided for in article L. 332-1, the decision imposing an obligation to leave French territory provided for in article L. 611-1 and the implementation of decisions taken by another State provided for in article L. 615-1, the foreign national may be surrendered, pursuant to international agreements or European Union law, to the competent authorities of another State, if he or she is in one of the cases provided for in Articles L. 621-2 to L. 621-7.
The foreign national is informed of this surrender by a written, reasoned decision taken by an administrative authority defined by decree in the Conseil d’État. The foreign national is given the opportunity to submit observations and to notify or have notified his consulate, a counsel or any person of his choice.

Article L621-1

Par dérogation au refus d’entrée à la frontière prévu à l’article L. 332-1, à la décision portant obligation de quitter le territoire français prévue à l’article L. 611-1 et à la mise en œuvre des décisions prises par un autre État prévue à l’article L. 615-1, l’étranger peut être remis, en application des conventions internationales ou du droit de l’Union européenne, aux autorités compétentes d’un autre État, lorsqu’il se trouve dans l’un des cas prévus aux articles L. 621-2 à L. 621-7.
L’étranger est informé de cette remise par décision écrite et motivée prise par une autorité administrative définie par décret en Conseil d’État. Il est mis en mesure de présenter des observations et d’avertir ou de faire avertir son consulat, un conseil ou toute personne de son choix.
