Article L621-16 of the French Monetary and Financial Code

Where the AMF Enforcement Committee has imposed a financial penalty that has become final before the criminal court has given a final ruling on related facts, the criminal court may order that the financial penalty be deducted from the fine it imposes.

Lorsque la Commission des sanctions de l’Autorité des marchés financiers a prononcé une sanction pécuniaire devenue définitive avant que le juge pénal ait statué définitivement sur des faits connexes, celui-ci peut ordonner que la sanction pécuniaire s’impute sur l’amende qu’il prononce.
