When the AMF forwards certain facts or information to the Financial Public Prosecutor pursuant to Article L. 621-20-1, certain facts or information to the Financial Public Prosecutor, the report or notification provided for in Article 16 of Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 2014 on market abuse (Market Abuse Regulation) and repealing Directive 2003/6/EC of the European Parliament and of the Council and Commission Directives 2003/124/EC, 2003/125/EC and 2004/72/EC, of which the Public Prosecutor is notified, is not included in the record of proceedings.

Lorsque l’Autorité des marchés financiers transmet, en application de l’article L. 621-20-1, certains faits ou informations au procureur de la République financier, la déclaration ou la notification prévue à l’article 16 du règlement (UE) n° 596/2014 du Parlement européen et du Conseil du 16 avril 2014 sur les abus de marché (règlement relatif aux abus de marché) et abrogeant la directive 2003/6/CE du Parlement européen et du Conseil et les directives 2003/124/CE, 2003/125/CE et 2004/72/CE de la Commission, dont le procureur de la République est avisé, ne figure pas au dossier de la procédure.
