Article L621-24 of the French Monetary and Financial Code

Statutory auditors are required to report to the AMF as soon as possible any fact or decision concerning an investment services provider or an intermediary authorised to hold or administer financial instruments of which they have become aware in the course of their duties and which may constitute a breach of the provisions of the AMF General Regulation relating to the rules of conduct or the conditions for carrying on the business of holding or administering financial instruments. The AMF may also provide the statutory auditors of ISPs with the information they need to perform their duties. The information thus transmitted is covered by the rule of professional secrecy.

Les commissaires aux comptes sont tenus de signaler dans les meilleurs délais à l’Autorité tout fait ou décision concernant un prestataire de services d’investissement ou un intermédiaire habilité en vue de la conservation ou de l’administration d’instruments financiers, dont ils ont eu connaissance dans l’exercice de leur mission et de nature à constituer une violation des dispositions du règlement général de l’Autorité des marchés financiers relatives aux règles de bonne conduite ou aux conditions d’exercice des activités de conservation ou d’administration d’instruments financiers. L’Autorité des marchés financiers peut également transmettre aux commissaires aux comptes des prestataires de services d’investissement les informations nécessaires à l’accomplissement de leur mission. Les informations ainsi transmises sont couvertes par la règle du secret professionnel.
