A decision to surrender to the competent authorities of a Member State of the European Union may be issued to a foreign national and his or her family members, admitted to reside in the territory of that State and carrying out an intra-group temporary posting in accordance with Directive 2014/66/EU of the European Parliament and of the Council of 15 May 2014 on the conditions of entry and residence of third-country nationals in the context of an intra-group temporary transfer, where that foreign national is in one of the following situations:
1° The residence permit has expired or has been withdrawn by the State which issued it, during the period of mobility;
2° The administrative authority has not received notification of the foreign national’s intention to work in one of the establishments of his or her original group of companies located on French territory;
3° The administrative authority has objected to the mobility of this foreign national for a period of less than or equal to ninety days;
4° The administrative authority has rejected a request from this foreign national for mobility for a period of more than ninety days;
5° The conditions for issuing the residence permit have not been met;
6° The conditions under which the mobility of this foreign national between two States mentioned in Article L. 621-1 were authorised are no longer met.
