If the apprentice training centre decides to exclude the apprentice permanently, the employer may initiate dismissal proceedings against the apprentice. This exclusion constitutes real and serious grounds for dismissal, which is decided under the conditions laid down in the provisions of the Labour Code relating to termination of the employment contract on personal grounds. The apprentice training centre or the apprentice may refer the matter to the mediator mentioned in article L. 6222-39 and, for apprentices in the non-industrial and commercial public sector, to the department designated as responsible for mediation.
If the apprentice is unable to enrol in a new apprentice training centre within two months of his definitive exclusion, his continued employment with the company is subject to the conclusion either of an employment contract under the conditions of ordinary law, or of an amendment putting an end to the apprenticeship period when the apprenticeship contract is concluded for an indefinite period.
