Article L623-1 of the French Consumer Code

A nationally representative consumer defence association approved under Article L. 811-1 may bring an action before a civil court to obtain compensation for individual losses suffered by consumers placed in a similar or identical situation and having as their common cause a breach by one or more of the same traders of their legal obligations, whether or not covered by this code, or contractual obligations :

<1° In connection with the sale of goods or the provision of services as well as in connection with the rental of property;

<2° Or where such losses result from anti-competitive practices within the meaning of Title II of Book IV of the Commercial Code or Articles 101 and 102 of the Treaty on the Functioning of the European Union.

Une association de défense des consommateurs représentative au niveau national et agréée en application de l’article L. 811-1 peut agir devant une juridiction civile afin d’obtenir la réparation des préjudices individuels subis par des consommateurs placés dans une situation similaire ou identique et ayant pour cause commune un manquement d’un ou des mêmes professionnels à leurs obligations légales, relevant ou non du présent code, ou contractuelles :


1° A l’occasion de la vente de biens ou de la fourniture de services ainsi que dans le cadre de la location d’un bien immobilier ;


2° Ou lorsque ces préjudices résultent de pratiques anticoncurrentielles au sens du titre II du livre IV du code de commerce ou des articles 101 et 102 du traité sur le fonctionnement de l’Union européenne.
