Article L623-27-1-1 of the French Intellectual Property Code

The court may order, of its own motion or at the request of any person with standing to bring an infringement action, all legally permissible investigative measures even if a seizure for infringement has not previously been ordered under the conditions set out in l’article L. 623-27-1.

La juridiction peut ordonner, d’office ou à la demande de toute personne ayant qualité pour agir en contrefaçon, toutes les mesures d’instruction légalement admissibles même si une saisie-contrefaçon n’a pas préalablement été ordonnée dans les conditions prévues à l’article L. 623-27-1.
