Article L6235-2 of the French Labour Code

I.-The procedures for implementing cross-border apprenticeships are specified in an agreement concluded between France and the border country in which the practical or theoretical part of the apprenticeship training is provided.

II.-The agreement referred to in I specifies in particular

1° the provisions relating to the legal system applicable to the employment contract, particularly with regard to working conditions and remuneration, health and safety at work and the social protection of the apprentice, when the practical part of the apprenticeship training is carried out in the border country;

2° the provisions relating to the training body and the professional certification covered by the contract, as well as the procedures applicable to the conduct of the training and the award of the professional certification, when the theoretical part of the apprenticeship training is carried out in the border country;

3° The provisions relating to the financing of cross-border apprenticeships, in particular the contributions of the parties and their financial relations.

Article L6235-2

I.-Les modalités de mise en œuvre de l’apprentissage transfrontalier sont précisées dans le cadre d’une convention conclue entre la France et le pays frontalier dans lequel est réalisée la partie pratique ou la partie théorique de la formation par apprentissage.

II.-La convention mentionnée au I précise notamment :

1° Les dispositions relatives au régime juridique applicable au contrat de travail, concernant notamment les conditions de travail et de rémunération, la santé et la sécurité au travail ainsi que la protection sociale de l’apprenti, lorsque la partie pratique de la formation par apprentissage est réalisée dans le pays frontalier ;

2° Les dispositions relatives à l’organisme de formation et à la certification professionnelle visée par le contrat ainsi que les modalités applicables au déroulement de la formation et à la délivrance de la certification professionnelle, lorsque la partie théorique de la formation par apprentissage est réalisée dans le pays frontalier ;

3° Les dispositions relatives au financement de l’apprentissage transfrontalier, notamment les contributions des parties et leurs relations sur le plan financier.
