Article L632-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The summons referred to in 2° of article L. 632-1 is given to the foreign national at least fifteen days before the committee meeting. It specifies that the person concerned has the right to be assisted by counsel or any person of their choice and to be heard with an interpreter.
The foreign national may apply for legal aid under the conditions laid down by law no. 91-647 of 10 July 1991 relating to legal aid. This option is indicated in the summons. Provisional admission to legal aid may be granted by the chairman of the committee.
The committee’s proceedings are public. The chairman keeps the meeting in order. Anything he/she orders to ensure order is carried out immediately. Before the committee, the foreign national may put forward all the reasons against his or her expulsion. A report recording the foreign national’s explanations is forwarded, along with the committee’s reasoned opinion, to the administrative authority competent to take a decision. The committee’s opinion is also communicated to the foreign national concerned.
The committee delivers its opinion within one month of the foreign national receiving the summons referred to in the first paragraph. However, if the foreign national requests removal for a legitimate reason, the Commission will extend this period, up to a maximum of one month from the date of the decision granting removal. At the end of the one-month period or, if the committee has extended it, the additional period it has set, the formalities for consulting the committee are deemed to have been completed.

Article L632-2

La convocation mentionnée au 2° de l’article L. 632-1 est remise à l’étranger quinze jours au moins avant la réunion de la commission. Elle précise que l’intéressé a le droit d’être assisté d’un conseil ou de toute personne de son choix et d’être entendu avec un interprète.
L’étranger peut demander le bénéfice de l’aide juridictionnelle dans les conditions prévues par la loi n° 91-647 du 10 juillet 1991 relative à l’aide juridique. Cette faculté est indiquée dans la convocation. L’admission provisoire à l’aide juridictionnelle peut être prononcée par le président de la commission.
Les débats de la commission sont publics. Le président veille à l’ordre de la séance. Tout ce qu’il ordonne pour l’assurer est immédiatement exécuté. Devant la commission, l’étranger peut faire valoir toutes les raisons qui militent contre son expulsion. Un procès-verbal enregistrant les explications de l’étranger est transmis, avec l’avis motivé de la commission, à l’autorité administrative compétente pour statuer. L’avis de la commission est également communiqué à l’intéressé.
La commission rend son avis dans le délai d’un mois à compter de la remise à l’étranger de la convocation mentionnée au premier alinéa. Toutefois, lorsque l’étranger demande le renvoi pour un motif légitime, la commission prolonge ce délai, dans la limite d’un mois maximum à compter de la décision accordant ce renvoi. A l’issue du délai d’un mois ou, si la commission l’a prolongé, du délai supplémentaire qu’elle a fixé, les formalités de consultation de la commission sont réputées remplies.
