Article L632-4 of the French Monetary and Financial Code

Notwithstanding the provisions of this chapter, and notwithstanding the provisions of Law 68-678 of 26 July 1968 on the communication of economic, commercial, industrial, financial or technical documents and information to foreign natural or legal persons, the Autorité de contrôle prudentiel et de résolution and the Autorité des marchés financiers may transmit to the European System of Central Banks or the European Central Bank, acting as monetary authorities, information covered by professional secrecy intended for the performance of their tasks.

Notwithstanding the provisions of this chapter, the Banque de France, the Autorité de contrôle prudentiel et de résolution and the Autorité des marchés financiers may transmit to other public authorities responsible for overseeing payment systems and settlement and delivery systems for financial instruments information covered by professional secrecy intended for the performance of their duties.

Nonobstant les dispositions du présent chapitre, et par dérogation aux dispositions de la loi n° 68-678 du 26 juillet 1968 relative à la communication de documents et renseignements d’ordre économique, commercial, industriel, financier ou technique à des personnes physiques ou morales étrangères, l’Autorité de contrôle prudentiel et de résolution et l’Autorité des marchés financiers peuvent transmettre au Système européen de banques centrales ou à la Banque centrale européenne agissant en qualité d’autorités monétaires des informations couvertes par le secret professionnel destinées à l’exécution de leurs missions.

Nonobstant les dispositions du présent chapitre, la Banque de France, l’Autorité de contrôle prudentiel et de résolution et l’Autorité des marchés financiers peuvent transmettre à d’autres autorités publiques chargées de la surveillance des systèmes de paiement et des systèmes de règlement et de livraison des instruments financiers des informations couvertes par le secret professionnel destinées à l’exécution de leurs missions.
