Article L6323-3 of the French Labour Code

The rights registered on the personal training account remain acquired in the event of a change in the holder’s professional situation or loss of employment.

Rights acquired in hours, in accordance with article 22 quater of law no. 83-634 of 13 July 1983 on the rights and obligations of civil servants, are retained and converted into euros for the benefit of any person who, at the time of their request, is authorised, under a provision of this code, to use the rights recorded on their personal training account. The terms of application of this paragraph are set by decree in the Conseil d’Etat.

The personal training account ceases to be funded and the rights registered therein can no longer be used when the holder fulfils one of the conditions mentioned in 1° to 3° of article L. 5421-4.

However, by way of derogation from the third paragraph of this article, the rights registered on the personal training account as part of the civic commitment account in application of article L. 5151-9 may still be used to finance training initiatives designed to enable volunteers and voluntary firefighters to acquire the skills they need to carry out their duties.

Les droits inscrits sur le compte personnel de formation demeurent acquis en cas de changement de situation professionnelle ou de perte d’emploi de son titulaire.

Les droits acquis en heures, conformément à l’article 22 quater de la loi n° 83-634 du 13 juillet 1983 portant droits et obligations des fonctionnaires, sont conservés et convertis en euros au bénéfice de toute personne qui, au moment de sa demande, est autorisée, au titre d’une disposition du présent code, à utiliser les droits inscrits sur son compte personnel de formation. Les modalités d’application du présent alinéa sont fixées par décret en Conseil d’Etat.

Le compte personnel de formation cesse d’être alimenté et les droits qui y sont inscrits ne peuvent plus être mobilisés lorsque son titulaire remplit l’une des conditions mentionnées aux 1° à 3° de l’article L. 5421-4.

Toutefois, par dérogation au troisième alinéa du présent article, les droits inscrits sur le compte personnel de formation au titre du compte d’engagement citoyen en application de l’article L. 5151-9 demeurent mobilisables pour financer les actions de formation destinées à permettre aux volontaires, aux bénévoles et aux sapeurs-pompiers volontaires d’acquérir les compétences nécessaires à l’exercice de leurs missions.
