Article L652-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national who applies to the administrative court for the annulment of the decision imposing an obligation to leave French territory may accompany his appeal with a request to suspend its enforcement, without prejudice to the provisions of 1° of article L. 762-3.
As a result, articles L. 614-1 to L. 614-18, with the exception of article L. 614-13, are not applicable to Saint-Barthélemy. However, the provisions of the first two paragraphs of article L. 614-11 are applicable to the holding of the hearing mentioned in the second paragraph of article L. 522-1 of the Code of Administrative Justice when the foreign national has applied to the administrative court for a suspension on the basis of article L. 521-2 of the same code.

L’étranger qui demande au tribunal administratif l’annulation de la décision portant obligation de quitter le territoire français dont il fait l’objet peut assortir son recours d’une demande de suspension de son exécution, sans préjudice des dispositions du 1° de l’article L. 762-3.
En conséquence, les articles L. 614-1 à L. 614-18, à l’exception de l’article L. 614-13, ne sont pas applicables à Saint-Barthélemy. Toutefois, les dispositions des deux premiers alinéas de l’article L. 614-11 sont applicables à la tenue de l’audience mentionnée au deuxième alinéa de l’article L. 522-1 du code de justice administrative lorsque l’étranger a saisi le tribunal administratif d’une demande de suspension sur le fondement de l’article L. 521-2 du même code.
