I.-The court may declare the personal bankruptcy of any person mentioned in 1° of I of Article L. 653-1 , subject to the exceptions provided for in the last paragraph of I of the same article, against whom one of the following facts has been identified:
1° Having abusively pursued a loss-making operation which could only lead to the cessation of payments;
2° (Repealed).
3° Having misappropriated or concealed all or part of its assets or fraudulently increased its liabilities.
II.-In addition, subject to the same proviso, the following acts may be held against a limited liability sole trader or a sole trader covered by the status defined in Section 3 of Chapter VI of Title II of Book V:
1° (Repealed)
2° Under cover of the business or assets covered by the proceedings masking his actions, having carried out commercial acts in an interest other than that of that business or those assets;
3° Having made use of the assets or credit of the business or assets covered by the proceedings contrary to the interest of that business or those assets for personal purposes or to favour a legal person or business in which he was interested, directly or indirectly, or a separate asset belonging to him.
