The court may declare the personal bankruptcy of any director, de jure or de facto, of a legal person, against whom one of the following facts has been identified:
1° Having disposed of the assets of the legal person as if they were his own;
2° Under cover of the legal person masking his actions, having carried out commercial acts in a personal interest;
3° Having made use of the assets or credit of the legal person in a manner contrary to the interests of the latter for personal ends or to favour another legal person or business in which he was directly or indirectly interested ;
4° Avoir poursuivi abusivement, dans un intérêt personnel, une exploitation déficitaire qui ne pouvait conduire qu’à la cessation des paiements de la personne morale;
5° Avoir misapproprié ou dissimulé tout ou partie de l’actif ou frauduleusement augmenté le passif de la personne morale.
