Article L692-9 of the French Commercial code

The judgment which rules on the applications of local creditors seeking, on the basis of Article 36(9) of the aforementioned Regulation (EU) No 2015/848, provisional or protective measures to ensure compliance with the terms of the undertaking by the insolvency practitioner of the main insolvency proceedings may be appealed by that practitioner, the debtor in possession, the applicant local creditor and the public prosecutor. Where appropriate, the insolvency practitioner of the main insolvency proceedings may lodge a third party objection.

Le jugement qui statue sur les demandes des créanciers locaux tendant, sur le fondement du paragraphe 9 de l’article 36 du règlement (UE) n° 2015/848 précité, à ce que soient prises des mesures provisoires ou conservatoires en vue d’assurer le respect des termes de l’engagement par le praticien de l’insolvabilité de la procédure d’insolvabilité principale peut faire l’objet d’un appel de la part de ce praticien, du débiteur non dessaisi, du créancier local demandeur et du ministère public. Le cas échéant, le praticien de l’insolvabilité de la procédure d’insolvabilité principale peut former tierce opposition.
