Article L7123-3 of the French General Code of Local Authorities

The duties of president of the assembly of French Guyana are incompatible with the exercise of the following duties: mayor, president of a public establishment of inter-communal cooperation with its own tax system of more than 50,000 inhabitants, member of the European Commission, member of the executive board of the European Central Bank or member of the monetary policy council of the Banque de France.

If the President of the Assembly of French Guyana holds a position that places him or her in a situation of incompatibility as provided for in the first paragraph, he or she shall thereby cease to perform his or her duties as President of the Assembly of French Guyana. In the event of a dispute, the incompatibility takes effect from the date on which the court decision confirming the election becomes final.

Les fonctions de président de l’assemblée de Guyane sont incompatibles avec l’exercice des fonctions suivantes : maire, président d’un établissement public de coopération intercommunale à fiscalité propre de plus de 50 000 habitants, membre de la Commission européenne, membre du directoire de la Banque centrale européenne ou membre du conseil de la politique monétaire de la Banque de France.

Si le président de l’assemblée de Guyane exerce une fonction le plaçant dans une situation d’incompatibilité prévue au premier alinéa, il cesse de ce fait même d’exercer ses fonctions de président de l’assemblée de Guyane. En cas de contestation, l’incompatibilité prend effet à compter de la date à laquelle la décision juridictionnelle confirmant l’élection devient définitive.
