Article L713-3-2 of the French Intellectual Property Code

Subject to the application of the provisions of Article L. 716-4-4, the introduction into the national territory, in the course of trade, of goods, without their being put into free circulation there, is also prohibited where these goods, including packaging, come from third countries and are, without the proprietor’s authorisation, covered by a sign identical to the trade mark registered for these goods or by a sign which cannot be distinguished from it in its essential aspects.

Sous réserve de l’application des dispositions de l’article L. 716-4-4, est également interdite l’introduction sur le territoire national, dans la vie des affaires, de produits, sans qu’ils y soient mis en libre pratique, lorsque ces produits, conditionnement inclus, proviennent de pays tiers et sont, sans autorisation du titulaire, revêtus d’un signe identique à la marque enregistrée pour ces produits ou d’un signe qui ne peut en être distingué dans ses aspects essentiels.
