Article L715-5 of the French Intellectual Property Code

In addition to the grounds for revocation provided for in Articles L. 714-5 and L. 714-6, the owner of the guarantee mark shall be declared to have forfeited his rights on the following grounds:

1° The proprietor no longer satisfies the conditions of article L. 715-2;

2° The proprietor has failed to take reasonable steps to prevent use of the trade mark that is not compatible with the regulations governing its use;

3° As a result of use by authorised persons, the mark has become liable to mislead the public within the meaning of the second paragraph of Article L. 715-4;

4° An amendment to the regulations governing use has rendered them non-compliant with the conditions laid down in Articles L. 715-1 and L. 715-2 or contrary to public policy.

Article L715-5

Outre les motifs de déchéance prévus aux articles L. 714-5 et L. 714-6, le titulaire de la marque de garantie est déclaré déchu de ses droits pour les motifs suivants :


1° Le titulaire ne satisfait plus aux conditions de l’article L. 715-2 ;


2° Le titulaire ne prend pas de mesures raisonnables en vue de prévenir un usage de la marque qui ne serait pas compatible avec le règlement d’usage ;


3° La marque est devenue, du fait de l’usage par les personnes habilitées, susceptible d’induire le public en erreur au sens du second alinéa de l’article L. 715-4 ;


4° Une modification du règlement d’usage l’a rendu non conforme aux conditions prévues aux articles L. 715-1 et L. 715-2 ou contraire à l’ordre public.
